Contractual relations between the holders of rights and VGF are regulated by an Rights Administration Agreement (supplied as a pdf file). On the basis of this agreement, persons entitled to receive royalties transfer their individual rights (those under § 54 UrhG and § 27 UrhG [Copyright Act] in particular, as well as cable retransmission rights) to VGF, to be administered by VGF acting as a trustee. It should be stressed here that the transfer of rights does not include any licence rights, so film producers and rights holders remain completely free in the exploitation of their films. The conclusion of a Rights Administration Agreement forms the essential basis for the receipt of remuneration. VGF needs to be vested in these rights in order to conclude the agreements and contracts necessary for collection, and to assert the rights in relation to users of the works.
